        "text": "PER CURIAM. This appeal presents a new variation on a",

        "text": "recurring scenario that requires federal courts in Illinois to",
        "paragraph_id": "para_21"
      },
      {
        "text": "split some fine hairs in the law of claim preclusion. A public",
        "paragraph_id": "para_22"
      },
      {
        "text": "employee believed his employer had taken action against him",
        "paragraph_id": "para_23"
      },
      {
        "text": "for unlawful reasons. He sought relief under both state and",
        "paragraph_id": "para_24"
      },
      {
        "text": "federal law, including the federal Constitution, and in both",
        "paragraph_id": "para_25"
      },
      {
        "text": "administrative proceedings and lawsuits. As we explain",
        "paragraph_id": "para_26"
      },
      {

        "text": "below, principles of claim preclusion block most of plaintiff’s",
        "paragraph_id": "para_28"
      },
      {
        "text": "claims but not those under Title VII of the Civil Rights Act of",
        "paragraph_id": "para_29"
      },
      {
        "text": "1964.",
        "paragraph_id": "para_30"
      },
      {
        "text": "Plaintiff Vairrun Strickland, an African American man,",
        "paragraph_id": "para_31"
      },
      {
        "text": "was fired from his job as a firefighter for the City of Markham,",
        "paragraph_id": "para_32"
      },
      {
        "text": "Illinois. Strickland first sued in state court challenging the",
        "paragraph_id": "para_33"
      },
      {
        "text": "administrative decision that led to his firing. He then filed this",
        "paragraph_id": "para_34"
      },
      {
        "text": "federal lawsuit against the City of Markham and the Fire",
        "paragraph_id": "para_35"
      },
      {
        "text": "Chief Anthony Mazziotta. This suit asserts civil rights claims",
        "paragraph_id": "para_36"
      },
      {
        "text": "under Title VII of the Civil Rights Act of 1964, the Fourteenth",
        "paragraph_id": "para_37"
      },
      {
        "text": "Amendment to the United States Constitution, and the Illinois",
        "paragraph_id": "para_38"
      },
      {
        "text": "State Officials and Employees Ethics Act. Strickland then",
        "paragraph_id": "para_39"
      },
      {
        "text": "voluntarily dismissed his lawsuit in state court. The federal",
        "paragraph_id": "para_40"
      },
      {
        "text": "district court then concluded that this entire federal suit is",
        "paragraph_id": "para_41"
      },
      {
        "text": "foreclosed by principles of claim preclusion based on the",
        "paragraph_id": "para_42"
      },
      {
        "text": "adverse administrative ruling under Illinois law. The district",
        "paragraph_id": "para_43"
      },
      {
        "text": "court granted summary judgment for the defendants on all",
        "paragraph_id": "para_44"
      },
      {
        "text": "claims.",
        "paragraph_id": "para_45"
      },
      {
        "text": "We affirm in part and vacate and remand in part. Federal",
        "paragraph_id": "para_46"
      },
      {
        "text": "law treats a state court’s judgment and a decision in an",
        "paragraph_id": "para_47"
      },
      {
        "text": "administrative proceeding differently for purposes of claim",
        "paragraph_id": "para_48"
      },
      {
        "text": "preclusion. Because the district court overlooked this",
        "paragraph_id": "para_49"
      },
      {
        "text": "threshold issue of federal law, it erred in entering summary",
        "paragraph_id": "para_50"
      },
      {
        "text": "judgment on Strickland’s Title VII claims. But this distinction",
        "paragraph_id": "para_51"
      },
      {
        "text": "does not alter the outcome on Strickland’s other claims, and",
        "paragraph_id": "para_52"
      },
      {
        "text": "the district court otherwise correctly applied the Illinois law",
        "paragraph_id": "para_53"
      },
      {
        "text": "of claim preclusion.",
        "paragraph_id": "para_54"
      },
      {
        "text": "I. Factual and Procedural Background",
        "paragraph_id": "para_55"
      },
      {
        "text": "Strickland worked as a firefighter for the City of Markham",
        "paragraph_id": "para_56"
      },
      {
        "text": "Fire Department for over a decade. In 2020, the Equal",
        "paragraph_id": "para_57"
      },
      {

        "text": "Employment Opportunity Commission interviewed",
        "paragraph_id": "para_59"
      },
      {
        "text": "Strickland during an investigation into discrimination claims",
        "paragraph_id": "para_60"

        "text": "brought by a former firefighter. In the interview, Strickland",
        "paragraph_id": "para_61"
      },
      {
        "text": "described race-based discrimination he had witnessed against",
        "paragraph_id": "para_62"
      },
      {
        "text": "the former firefighter and how Chief Mazziotta had failed to",
        "paragraph_id": "para_63"
      },
      {
        "text": "address it. Strickland alleged that after the interview, Chief",
        "paragraph_id": "para_64"
      },
      {
        "text": "Mazziotta and the Department retaliated against him by",
        "paragraph_id": "para_65"
      },
      {
        "text": "singling him out for minor disciplinary issues and denying",
        "paragraph_id": "para_66"
      },
      {
        "text": "him a promotion.",
        "paragraph_id": "para_67"
      },
      {
        "text": "In January 2021, the Department brought administrative",
        "paragraph_id": "para_68"
      },
      {
        "text": "charges against Strickland. After hearings on the charges, the",
        "paragraph_id": "para_69"
      },
      {
        "text": "Board of Fire and Police Commissioners terminated his",
        "paragraph_id": "para_70"
      },
      {
        "text": "employment in April 2021, finding that Strickland had lied to",
        "paragraph_id": "para_71"
      },
      {
        "text": "detectives during an arson investigation and had put",
        "paragraph_id": "para_72"
      },
      {
        "text": "Department employees at risk by coming to work while",
        "paragraph_id": "para_73"
      },
      {
        "text": "infected with COVID-19.",
        "paragraph_id": "para_74"
      },
      {
        "text": "The next month, Strickland filed a lawsuit in state court",
        "paragraph_id": "para_75"
      },
      {
        "text": "challenging the Board’s decision. The court remanded while",
        "paragraph_id": "para_76"
      },
      {
        "text": "retaining jurisdiction over the case and instructed the Board",
        "paragraph_id": "para_77"
      },
      {
        "text": "to enter an amended decision with additional information.",
        "paragraph_id": "para_78"
      },
      {
        "text": "The Board did so and again discharged Strickland. After the",
        "paragraph_id": "para_79"
      },
      {
        "text": "Board issued its amended decision in April 2022, Strickland",
        "paragraph_id": "para_80"
      },
      {
        "text": "voluntarily dismissed his state-court lawsuit. He did not",
        "paragraph_id": "para_81"
      },
      {
        "text": "otherwise seek direct review of the amended decision in state",
        "paragraph_id": "para_82"
      },
      {
        "text": "court.",
        "paragraph_id": "para_83"
      },
      {
        "text": "In the meantime, in March 2022, Strickland had already",
        "paragraph_id": "para_84"
      },
      {
        "text": "filed this suit in federal court. Strickland alleged that the City",
        "paragraph_id": "para_85"
      },
      {
        "text": "of Markham and Chief Mazziotta discriminated against him",
        "paragraph_id": "para_86"
      },
      {
        "text": "based on race and retaliated against him in violation of Title",
        "paragraph_id": "para_87"
      },
      {
        "text": "VII, see 42 U.S.C. §§ 2000e–2 & 2000e–3, and Illinois state law,",
        "paragraph_id": "para_88"
      },
      {
        "text": "see 5 ILCS 430/1, and denied him equal protection of the law",
        "paragraph_id": "para_89"
      },
      {

        "text": "in violation of the Fourteenth Amendment, seeking relief",
        "paragraph_id": "para_91"
      },
      {
        "text": "under 42 U.S.C. § 1983.",

        "text": "After Strickland voluntarily dismissed his suit in state",
        "paragraph_id": "para_93"
      },
      {
        "text": "court, the City of Markham and Chief Mazziotta moved to",
        "paragraph_id": "para_94"
      },
      {
        "text": "dismiss the federal complaint. The defendants argued that",
        "paragraph_id": "para_95"
      },
      {
        "text": "Strickland’s claims were precluded by the outcomes of the",
        "paragraph_id": "para_96"
      },
      {
        "text": "Board hearing and state-court suit. Under Rule 12(d), the",
        "paragraph_id": "para_97"
      },
      {
        "text": "district court converted the defendants’ motions to dismiss",
        "paragraph_id": "para_98"
      },
      {
        "text": "into motions for summary judgment, which was sensible",
        "paragraph_id": "para_99"
      },
      {
        "text": "because the motions involved an affirmative defense and",

      },
      {
        "text": "evidence beyond the pleadings.",

        "text": "Applying 28 U.S.C. § 1738, the district court concluded",

        "text": "that Illinois claim preclusion principles barred Strickland’s",
        "paragraph_id": "para_103"
      },
      {
        "text": "federal action. First, it determined that under Illinois law, the",
        "paragraph_id": "para_104"
      },
      {
        "text": "Board’s decision was a final judgment on the merits because",
        "paragraph_id": "para_105"
      },
      {
        "text": "the proceeding was judicial in nature and was not timely",
        "paragraph_id": "para_106"
      },
      {
        "text": "challenged. Next, the court explained that although",
        "paragraph_id": "para_107"
      },
      {
        "text": "Strickland’s state and federal suits asserted different theories",
        "paragraph_id": "para_108"
      },
      {
        "text": "of relief, both actions shared an identity of the causes of action",
        "paragraph_id": "para_109"
      },
      {
        "text": "because they arose from the same operative facts: Strickland’s",
        "paragraph_id": "para_110"
      },
      {
        "text": "termination. There also was no dispute over an identity of",
        "paragraph_id": "para_111"
      },
      {
        "text": "parties.",
        "paragraph_id": "para_112"
      },
      {
        "text": "Finally, the court concluded that Strickland had a “full and",
        "paragraph_id": "para_113"
      },
      {
        "text": "fair opportunity” to litigate his claims, as required by Illinois",
        "paragraph_id": "para_114"
      },
      {
        "text": "law and general due process principles. Applying Welch v.",
        "paragraph_id": "para_115"
      },
      {
        "text": "Johnson, 907 F.2d 714 (7th Cir. 1990), the district court",
        "paragraph_id": "para_116"
      },
      {
        "text": "determined that Strickland could have raised the thrust of his",
        "paragraph_id": "para_117"
      },
      {
        "text": "civil rights claims as defenses in the Board proceeding. The",
        "paragraph_id": "para_118"
      },
      {
        "text": "court also explained that Strickland could have joined those",
        "paragraph_id": "para_119"
      },
      {
        "text": "claims with his state suit challenging the Board’s decision if",
        "paragraph_id": "para_120"
      },
      {
        "text": "he had not instead voluntarily dismissed the suit.",
        "paragraph_id": "para_121"
      },
      {
        "text": "No. 24-3262 5",
        "paragraph_id": "para_122"
      },
      {
        "text": "II. Analysis",
        "paragraph_id": "para_123"
      },
      {
        "text": "On appeal, Strickland argues that the district court’s",
        "paragraph_id": "para_124"
      },
      {
        "text": "claim-preclusion analysis erred because it treated the Board’s",
        "paragraph_id": "para_125"
      },
      {
        "text": "decision and the state-court lawsuit as equivalents. In Illinois,",
        "paragraph_id": "para_126"
      },
      {
        "text": "the defense of claim preclusion has three primary elements:",
        "paragraph_id": "para_127"
      },
      {
        "text": "(1) a final judgment on the merits rendered by a court of",
        "paragraph_id": "para_128"
      },
      {
        "text": "competent jurisdiction; (2) an identity of cause of action; and",
        "paragraph_id": "para_129"
      },
      {
        "text": "(3) an identity of parties. Village of Bartonville v. Lopez,",
        "paragraph_id": "para_130"
      },
      {
        "text": "77 N.E.3d 639, 650 (Ill. 2017). Under general principles of due",
        "paragraph_id": "para_131"
      },
      {
        "text": "process and equity, litigants are also entitled to a full and fair",
        "paragraph_id": "para_132"
      },
      {
        "text": "opportunity to litigate their claims before preclusion applies.",
        "paragraph_id": "para_133"
      },
      {
        "text": "Welch, 907 F.2d at 723; Nowak v. St. Rita High Sch., 757 N.E.2d",
        "paragraph_id": "para_134"
      },
      {
        "text": "471, 478 (Ill. 2001). Strickland argues that the court improperly",
        "paragraph_id": "para_135"
      },
      {
        "text": "rested the first element on the Board’s decision and resolved",
        "paragraph_id": "para_136"
      },
      {
        "text": "the other questions based on the state suit. He maintains that",
        "paragraph_id": "para_137"
      },
      {
        "text": "administrative proceedings and state-court judgments should",
        "paragraph_id": "para_138"
      },
      {
        "text": "be evaluated differently for purposes of claim preclusion.",
        "paragraph_id": "para_139"
      },
      {
        "text": "Strickland is partially correct that the administrative",
        "paragraph_id": "para_140"
      },
      {
        "text": "proceedings and state litigation cannot be treated as",
        "paragraph_id": "para_141"
      },
      {
        "text": "equivalents. The Supreme Court’s decisions on the federal",
        "paragraph_id": "para_142"
      },
      {
        "text": "law of preclusion distinguish between state-court judgments",
        "paragraph_id": "para_143"
      },
      {
        "text": "and administrative decisions, particularly as applied to Title",
        "paragraph_id": "para_144"
      },
      {
        "text": "VII claims.",
        "paragraph_id": "para_145"
      },
      {
        "text": "Under 28 U.S.C. § 1738, federal courts must give full faith",
        "paragraph_id": "para_146"
      },
      {
        "text": "and credit to the “judicial proceedings of any court” of a state.",
        "paragraph_id": "para_147"
      },
      {
        "text": "This means federal courts apply the same preclusive effect to",
        "paragraph_id": "para_148"
      },
      {
        "text": "a state court’s judgment as the state’s own courts would.",
        "paragraph_id": "para_149"
      },
      {
        "text": "Walczak v. Chicago Bd. of Educ., 739 F.3d 1013, 1016 (7th Cir.",
        "paragraph_id": "para_150"
      },
      {
        "text": "2014) (citations omitted). In University of Tennessee v. Elliott,",
        "paragraph_id": "para_151"
      },
      {
        "text": "478 U.S. 788, 794 (1986), the Supreme Court recognized that",
        "paragraph_id": "para_152"
      },
      {
        "text": "§ 1738 extends by its terms to only a state court’s judgment—",
        "paragraph_id": "para_153"
      },
      {
        "text": "6 No. 24-3262",
        "paragraph_id": "para_154"
      },
      {
        "text": "not to “unreviewed” state administrative proceedings. Those",
        "paragraph_id": "para_155"
      },
      {
        "text": "administrative proceedings receive preclusive effect at most",
        "paragraph_id": "para_156"
      },
      {
        "text": "through federal common-law rules of preclusion. Id. (“…",
        "paragraph_id": "para_157"
      },
      {
        "text": "Congress did not intend unreviewed state administrative",
        "paragraph_id": "para_158"
      },
      {
        "text": "proceedings to have preclusive effect on Title VII claims.”).",
        "paragraph_id": "para_159"
      },
      {
        "text": "The Court concluded that under federal common law,",
        "paragraph_id": "para_160"
      },
      {
        "text": "administrative proceedings alone cannot preclude Title VII",
        "paragraph_id": "para_161"
      },
      {
        "text": "claims. Id. at 796; see also Astoria Fed. Sav. & Loan Ass'n v.",
        "paragraph_id": "para_162"
      },
      {
        "text": "Solimino, 501 U.S. 104, 110 (1991) (applying same reasoning to",
        "paragraph_id": "para_163"
      },
      {
        "text": "Age Discrimination in Employment Act).",
        "paragraph_id": "para_164"
      },
      {
        "text": "On the other hand, the Court held in Elliott, federal",
        "paragraph_id": "para_165"
      },
      {
        "text": "common law permits unreviewed state administrative",
        "paragraph_id": "para_166"
      },
      {
        "text": "proceedings to preclude claims under 42 U.S.C. § 1983 and",
        "paragraph_id": "para_167"
      },
      {
        "text": "similar civil rights statutes if the state agency was “acting in a",
        "paragraph_id": "para_168"
      },
      {
        "text": "judicial capacity.” Elliott, 478 U.S. at 799, quoting United States",
        "paragraph_id": "para_169"
      },
      {
        "text": "v. Utah Const. & Min. Co., 384 U.S. 394, 422 (1966). So at least",
        "paragraph_id": "para_170"
      },
      {
        "text": "for Title VII claims, state administrative decisions have no",
        "paragraph_id": "para_171"
      },
      {
        "text": "preclusive effect until the decision has been reviewed in state",
        "paragraph_id": "para_172"
      },
      {
        "text": "court and culminated in a judgment that is then treated like",
        "paragraph_id": "para_173"
      },
      {
        "text": "any other judgment. See Welch, 907 F.2d at 719. The district",
        "paragraph_id": "para_174"
      },
      {
        "text": "court therefore erred by concluding that the Board’s decision,",
        "paragraph_id": "para_175"
      },
      {
        "text": "standing alone “regardless of the subsequent dismissal,”",
        "paragraph_id": "para_176"
      },
      {
        "text": "could preclude Strickland’s Title VII claim.",
        "paragraph_id": "para_177"
      },
      {
        "text": "As for Strickland’s voluntary dismissal of his state court",
        "paragraph_id": "para_178"
      },
      {
        "text": "suit, the district court correctly rejected the defendants’",
        "paragraph_id": "para_179"
      },
      {
        "text": "arguments that this dismissal itself had any preclusive effect.",
        "paragraph_id": "para_180"
      },
      {
        "text": "A voluntary dismissal in state court may, in principle, amount",
        "paragraph_id": "para_181"
      },
      {
        "text": "to a state court’s judgment for purposes of § 1738. But § 1738",
        "paragraph_id": "para_182"
      },
      {
        "text": "still requires federal courts to afford that judgment only the",
        "paragraph_id": "para_183"
      },
      {
        "text": "same preclusive effect it would receive in the state’s courts.",
        "paragraph_id": "para_184"
      },
      {
        "text": "See Brye v. Brakebush, 32 F.3d 1179, 1183–84 (7th Cir. 1994)",
        "paragraph_id": "para_185"
      },
      {
        "text": "No. 24-3262 7",
        "paragraph_id": "para_186"
      },
      {
        "text": "(concluding voluntary dismissal was judgment of a court",
        "paragraph_id": "para_187"
      },
      {
        "text": "under § 1738 and Elliott but not preclusive under Wisconsin",
        "paragraph_id": "para_188"
      },
      {
        "text": "law).",
        "paragraph_id": "para_189"
      },
      {
        "text": "Under Illinois law, voluntary dismissals should not be",
        "paragraph_id": "para_190"
      },
      {
        "text": "treated as final judgments on the merits where there are no",
        "paragraph_id": "para_191"
      },
      {
        "text": "claim-splitting concerns, see Richter v. Prairie Farms Dairy,",
        "paragraph_id": "para_192"
      },
      {
        "text": "Inc., 53 N.E.3d 1, 14 (Ill. 2016), and the district court expressly",
        "paragraph_id": "para_193"
      },
      {
        "text": "saw no such concerns here. Consistent with this principle,",
        "paragraph_id": "para_194"
      },
      {
        "text": "this court has understood that a challenge to an",
        "paragraph_id": "para_195"
      },
      {
        "text": "administrative proceeding voluntarily dismissed without",
        "paragraph_id": "para_196"
      },
      {
        "text": "prejudice in Illinois court makes that proceeding effectively",
        "paragraph_id": "para_197"
      },
      {
        "text": "“unreviewed” for purposes of Elliott. See Duggan v. Board of",
        "paragraph_id": "para_198"
      },
      {
        "text": "Educ. of E. Chi. Heights, Dist. No. 169, 818 F.2d 1291, 1292, 1297",
        "paragraph_id": "para_199"
      },
      {
        "text": "(7th Cir. 1987). Thus, (1) an unreviewed administrative",
        "paragraph_id": "para_200"
      },
      {
        "text": "proceeding has no preclusive effect under § 1738, regardless",
        "paragraph_id": "para_201"
      },
      {
        "text": "of what state law might say, and (2) Illinois state law does not",
        "paragraph_id": "para_202"
      },
      {
        "text": "give preclusive effect to this voluntary dismissal. The district",
        "paragraph_id": "para_203"
      },
      {
        "text": "court thus erred in dismissing Strickland’s Title VII claims on",
        "paragraph_id": "para_204"
      },
      {
        "text": "claim preclusion grounds.",
        "paragraph_id": "para_205"
      },
      {
        "text": "Although federal common law principles do not preclude",
        "paragraph_id": "para_206"
      },
      {
        "text": "Strickland’s Title VII claims, they do give the findings of an",
        "paragraph_id": "para_207"
      },
      {
        "text": "agency acting in a judicial capacity the same preclusive effect",
        "paragraph_id": "para_208"
      },
      {
        "text": "they would receive in the state courts with respect to",
        "paragraph_id": "para_209"
      },
      {
        "text": "Strickland’s § 1983 and state-law claims. See Elliott, 478 U.S.",
        "paragraph_id": "para_210"
      },
      {
        "text": "at 799. As the district court recognized, Illinois law provides",
        "paragraph_id": "para_211"
      },
      {
        "text": "that claim preclusion can apply to administrative decisions",
        "paragraph_id": "para_212"
      },
      {
        "text": "where the proceeding is adjudicatory or quasi-judicial in",
        "paragraph_id": "para_213"
      },
      {
        "text": "nature, and where the losing party fails to seek timely judicial",
        "paragraph_id": "para_214"
      },
      {
        "text": "review of the decision. See Village of Bartonville, 77 N.E.3d",
        "paragraph_id": "para_215"
      },
      {
        "text": "at 655.",
        "paragraph_id": "para_216"
      },
      {
        "text": "8 No. 24-3262",
        "paragraph_id": "para_217"
      },
      {
        "text": "Strickland’s remaining arguments challenging the district",
        "paragraph_id": "para_218"
      },
      {
        "text": "court’s application of Illinois law are without merit. He",
        "paragraph_id": "para_219"
      },
      {
        "text": "maintains that the state and federal proceedings did not share",
        "paragraph_id": "para_220"
      },
      {
        "text": "an identity of cause of action because he sought",
        "paragraph_id": "para_221"
      },
      {
        "text": "administrative review of the Board’s decision in state court",
        "paragraph_id": "para_222"
      },
      {
        "text": "and brought discrimination, retaliation, and equal protection",
        "paragraph_id": "para_223"
      },
      {
        "text": "claims in federal court.",
        "paragraph_id": "para_224"
      },
      {
        "text": "The district court correctly determined that, under Illinois",
        "paragraph_id": "para_225"
      },
      {
        "text": "law, Strickland’s state administrative proceeding and federal",
        "paragraph_id": "para_226"
      },
      {
        "text": "suits shared an identity of cause of action because both arose",
        "paragraph_id": "para_227"
      },
      {
        "text": "from the facts surrounding Strickland’s termination. In",
        "paragraph_id": "para_228"
      },
      {
        "text": "evaluating this element, Illinois courts use a “transactional",
        "paragraph_id": "para_229"
      },
      {
        "text": "test” which is satisfied when two proceedings “arise from a",
        "paragraph_id": "para_230"
      },
      {
        "text": "single group of operative facts, regardless of whether they",
        "paragraph_id": "para_231"
      },
      {
        "text": "assert different theories of relief.” River Park, Inc. v. City of",
        "paragraph_id": "para_232"
      },
      {
        "text": "Highland Park, 703 N.E.2d 883, 893 (Ill. 1998); see also Walczak,",
        "paragraph_id": "para_233"
      },
      {
        "text": "739 F.3d at 1016–17 (citations omitted). It therefore does not",
        "paragraph_id": "para_234"
      },
      {
        "text": "matter that Strickland raised different legal theories in court.",
        "paragraph_id": "para_235"
      },
      {
        "text": "See Sapp v. Foxx, 106 F.4th 660, 666–67 (7th Cir. 2024).",
        "paragraph_id": "para_236"
      },
      {
        "text": "To determine whether two cases encompass the same",
        "paragraph_id": "para_237"
      },
      {
        "text": "cause of action, courts “pragmatically” consider similarities",
        "paragraph_id": "para_238"
      },
      {
        "text": "in timing, scope, origin, or motivation of the actions. River",
        "paragraph_id": "para_239"
      },
      {
        "text": "Park, Inc., 703 N.E.2d at 893, quoting Restatement (Second) of",
        "paragraph_id": "para_240"
      },
      {
        "text": "Judgments § 24, at 196 (Am. Law Inst. 1982). Strickland",
        "paragraph_id": "para_241"
      },
      {
        "text": "argued before the Board that he should not have been fired",
        "paragraph_id": "para_242"
      },
      {
        "text": "and Chief Mazziotta was “out to get him.” And his federal",
        "paragraph_id": "para_243"
      },
      {
        "text": "complaint alleges that he was wrongly fired based on Chief",
        "paragraph_id": "para_244"
      },
      {
        "text": "Mazziotta’s discrimination and in retaliation for his protected",
        "paragraph_id": "para_245"
      },
      {
        "text": "actions. The termination of Strickland’s employment is the",
        "paragraph_id": "para_246"
      },
      {
        "text": "“underlying transaction” disputed in both proceedings. Hayes",
        "paragraph_id": "para_247"
      },
      {
        "text": "v. City of Chicago, 670 F.3d 810, 814 (7th Cir. 2012).",
        "paragraph_id": "para_248"
      },
      {
        "text": "No. 24-3262 9",
        "paragraph_id": "para_249"
      },
      {
        "text": "Finally, Strickland argues that he did not have a “full and",
        "paragraph_id": "para_250"
      },
      {
        "text": "fair opportunity to litigate” his civil rights claims in the earlier",
        "paragraph_id": "para_251"
      },
      {
        "text": "proceedings because he could not have brought those claims",
        "paragraph_id": "para_252"
      },
      {
        "text": "before the Board itself. He notes that the Board is not a judicial",
        "paragraph_id": "para_253"
      },
      {
        "text": "forum and has no jurisdiction over civil rights claims. He",
        "paragraph_id": "para_254"
      },
      {
        "text": "objects to the district court’s reliance on Welch v. Johnson,",
        "paragraph_id": "para_255"
      },
      {
        "text": "907 F.2d 714, to conclude otherwise and attempts to",
        "paragraph_id": "para_256"
      },
      {
        "text": "distinguish it factually and procedurally.",
        "paragraph_id": "para_257"
      },
      {
        "text": "The district court did not err when it concluded that",
        "paragraph_id": "para_258"
      },
      {
        "text": "Strickland had a full and fair opportunity to litigate.",
        "paragraph_id": "para_259"
      },
      {
        "text": "Strickland could have raised, but did not, the thrust of his",
        "paragraph_id": "para_260"
      },
      {
        "text": "discrimination and retaliation claims as defenses in the Board",
        "paragraph_id": "para_261"
      },
      {
        "text": "hearing. It is true that the Board did not have jurisdiction to",
        "paragraph_id": "para_262"
      },
      {
        "text": "adjudicate the precise claims Strickland brought in his federal",
        "paragraph_id": "para_263"
      },
      {
        "text": "action. But the same was true of the Civil Service Commission",
        "paragraph_id": "para_264"
      },
      {
        "text": "in Welch, which was not empowered to adjudicate the",
        "paragraph_id": "para_265"
      },
      {
        "text": "plaintiff’s civil rights claims. See 907 F.2d at 725. Consistent",
        "paragraph_id": "para_266"
      },
      {
        "text": "with Welch, this court has recognized that a plaintiff’s failure",
        "paragraph_id": "para_267"
      },
      {
        "text": "to raise a defense in an administrative hearing (that later",
        "paragraph_id": "para_268"
      },
      {
        "text": "became a final judgment) precludes that plaintiff from raising",
        "paragraph_id": "para_269"
      },
      {
        "text": "that claim offensively in a federal suit. See Abner v. Illinois",
        "paragraph_id": "para_270"
      },
      {
        "text": "Dep’t of Transp., 674 F.3d 716, 719 (7th Cir. 2012); Hayes,",
        "paragraph_id": "para_271"
      },
      {
        "text": "670 F.3d at 814–15 (collecting cases).",
        "paragraph_id": "para_272"
      },
      {
        "text": "Regardless of what state law might have said about its",
        "paragraph_id": "para_273"
      },
      {
        "text": "authority, the Board was not permitted to sustain a firing that",
        "paragraph_id": "para_274"
      },
      {
        "text": "violated federal law. See White v. Elrod, 816 F.2d 1172, 1175",
        "paragraph_id": "para_275"
      },
      {
        "text": "(7th Cir. 1987). At minimum, Strickland could have joined the",
        "paragraph_id": "para_276"
      },
      {
        "text": "civil rights claims with a request for judicial review of the",
        "paragraph_id": "para_277"
      },
      {
        "text": "administrative decision in a single suit. See Manley v. City of",
        "paragraph_id": "para_278"
      },
      {
        "text": "Chicago, 236 F.3d 392, 397 (7th Cir. 2001). Because he instead",
        "paragraph_id": "para_279"
      },
      {
        "text": "allowed the administrative decision to ripen into a final",
        "paragraph_id": "para_280"
      },
      {
        "text": "10 No. 24-3262",
        "paragraph_id": "para_281"
      },
      {
        "text": "judgment on the merits by not challenging it in state court, his",
        "paragraph_id": "para_282"
      },
      {
        "text": "§ 1983 and state law claims are barred by Illinois claim",
        "paragraph_id": "para_283"
      },
      {
        "text": "preclusion principles incorporated by federal common-law",
        "paragraph_id": "para_284"
      },
      {
        "text": "claim preclusion, even if not by § 1738.",
        "paragraph_id": "para_285"
      },
      {
        "text": "For these reasons, we VACATE the judgment with respect",
        "paragraph_id": "para_286"
      },
      {
        "text": "to Strickland’s Title VII claim, AFFIRM the balance of the",
        "paragraph_id": "para_287"
      },
      {
        "text": "judgment, and REMAND for further proceedings.",
        "paragraph_id": "para_288"
      }
