        "paragraph_id": "para_34"

        "text": "bank. The United States blocked the funds pursuant to the",
        "paragraph_id": "para_35"
      },

        "text": "International Emergency Economic Powers Act and then",
        "paragraph_id": "para_36"
      },

        "text": "initiated a civil-forfeiture action against them. Plaintiffs, who",
        "paragraph_id": "para_37"
      },
      {
        "text": "hold judgments against Iran for supporting terrorism, later",
        "paragraph_id": "para_38"
      },
      {
        "text": "sought to attach those same funds in order to execute their",
        "paragraph_id": "para_39"
      },
      {
        "text": "judgments. The district court quashed the attachments on two",
        "paragraph_id": "para_40"
      },
      {
        "text": "independent grounds: First, the funds were immune from",
        "paragraph_id": "para_41"
      },
      {
        "text": "attachment because the Terrorism Risk Insurance Act, which",
        "paragraph_id": "para_42"
      },
      {
        "text": "permits execution against certain blocked assets of designated",
        "paragraph_id": "para_43"
      },
      {
        "text": "state sponsors of terrorism, did not apply. Second, the",
        "paragraph_id": "para_44"
      },
      {
        "text": "government’s forfeiture action barred any later in rem",
        "paragraph_id": "para_45"
      },
      {
        "text": "proceeding against the same funds. We disagree on both",
        "paragraph_id": "para_46"
      },
      {
        "text": "points, so we reverse.",
        "paragraph_id": "para_47"
      },
      {

        "text": "A",
        "paragraph_id": "para_50"
      },
      {
        "text": "The Foreign Sovereign Immunities Act (FSIA) provides",
        "paragraph_id": "para_51"
      },
      {
        "text": "that foreign states are “immune from the jurisdiction” of United",
        "paragraph_id": "para_52"
      },
      {
        "text": "States courts unless one of its exceptions applies. 28 U.S.C.",
        "paragraph_id": "para_53"
      },
      {
        "text": "§ 1604. One of these is the terrorism exception—courts may",
        "paragraph_id": "para_54"
      },
      {
        "text": "enter damages judgments against foreign states that have been",
        "paragraph_id": "para_55"
      },
      {
        "text": "designated as state sponsors of terrorism for committing or",
        "paragraph_id": "para_56"
      },
      {
        "text": "supporting specified terrorist activities. Id. § 1605A(a)(1); see",
        "paragraph_id": "para_57"
      },
      {
        "text": "Bank Markazi v. Peterson, 578 U.S. 212, 216 (2016).",
        "paragraph_id": "para_58"
      },
      {
        "text": "The FSIA also provides the property of foreign states with",
        "paragraph_id": "para_59"
      },
      {
        "text": "immunities from attachment or execution. 28 U.S.C. § 1609.",
        "paragraph_id": "para_60"
      },
      {
        "text": "And it sets forth exceptions to these immunities. Id. § 1610.",
        "paragraph_id": "para_61"
      },
      {
        "text": "B",
        "paragraph_id": "para_62"
      },
      {
        "text": "Congress has authorized the President to regulate property",
        "paragraph_id": "para_63"
      },
      {
        "text": "owned by foreign governments or individuals in the interest of",
        "paragraph_id": "para_64"
      },
      {
        "text": "national security. Section 5(b) of the Trading with the Enemy",
        "paragraph_id": "para_65"
      },
      {
        "text": "Act (TWEA) authorizes the President to regulate “any property",
        "paragraph_id": "para_66"
      },
      {
        "text": "in which any foreign country or a national thereof has any",
        "paragraph_id": "para_67"
      },
      {
        "text": "interest,” 50 U.S.C. § 4305(b)(1)(B), but it applies only during",
        "paragraph_id": "para_68"
      },
      {
        "text": "wartime, id. § 4305(b)(1). Section 203 of the International",
        "paragraph_id": "para_69"
      },
      {
        "text": "Emergency Economic Powers Act (IEEPA), which contains no",
        "paragraph_id": "para_70"
      },
      {
        "text": "such limitation, is thus more prominent today. It enables the",
        "paragraph_id": "para_71"
      },
      {
        "text": "President to regulate transactions in property owned by “any",
        "paragraph_id": "para_72"
      },
      {
        "text": "foreign country or a national thereof,” id. § 1702(a)(1)(B), in",
        "paragraph_id": "para_73"
      },
      {
        "text": "order to address “any unusual and extraordinary threat … to the",
        "paragraph_id": "para_74"
      },
      {
        "text": "national security, foreign policy, or economy of the United",
        "paragraph_id": "para_75"
      },
      {
        "text": "States, if the President declares a national emergency with",
        "paragraph_id": "para_76"
      },
      {
        "text": "respect to such threat,” id. § 1701(a). The President has",
        "paragraph_id": "para_77"
      },
      {
        "text": "declared a national emergency relating to foreign terrorism",
        "paragraph_id": "para_78"
      },
      {
        "text": "and, pursuant to section 203, has “blocked” the property of",
        "paragraph_id": "para_79"
      },
      {
        "text": "4",

      },
      {
        "text": "persons designated as terrorists or supporters of terrorism. See",
        "paragraph_id": "para_81",
        "court_paragraph": 4
      },
      {
        "text": "Exec. Order No. 13,224, 66 Fed. Reg. 49,079, 49,079–80 (Sep.",
        "paragraph_id": "para_82"
      },
      {
        "text": "23, 2001). The Office of Foreign Assets Control (OFAC) is",
        "paragraph_id": "para_83"
      },
      {
        "text": "charged with implementing this directive. It has provided that",
        "paragraph_id": "para_84"
      },
      {
        "text": "when property of designated persons comes “within the United",
        "paragraph_id": "para_85"
      },
      {
        "text": "States” or “the possession or control of U.S. persons,” it is",
        "paragraph_id": "para_86"
      },
      {
        "text": "“blocked and may not be transferred, paid, exported,",
        "paragraph_id": "para_87"
      },
      {
        "text": "withdrawn or otherwise dealt in.” 31 C.F.R. § 594.201(a).",
        "paragraph_id": "para_88"
      },
      {
        "text": "However, OFAC may remove or qualify a block by issuing a",
        "paragraph_id": "para_89"
      },
      {
        "text": "license for specified uses or transactions. See id.",
        "paragraph_id": "para_90"
      },
      {
        "text": "C",
        "paragraph_id": "para_91"
      },
      {
        "text": "Congress has made assets blocked under TWEA or IEEPA",
        "paragraph_id": "para_92"
      },
      {
        "text": "available to victims of state-sponsored terrorism. First, it",
        "paragraph_id": "para_93"
      },
      {
        "text": "amended the FSIA to provide that the holder of a terrorism-",
        "paragraph_id": "para_94"
      },
      {
        "text": "based judgment against a foreign sovereign may attach",
        "paragraph_id": "para_95"
      },
      {
        "text": "property for which transactions are “prohibited or regulated”",
        "paragraph_id": "para_96"
      },
      {
        "text": "under TWEA or IEEPA. 28 U.SC. § 1610(f)(1)(A). But",
        "paragraph_id": "para_97"
      },
      {
        "text": "Congress also authorized the President to waive section 1610(f)",
        "paragraph_id": "para_98"
      },
      {
        "text": "“in the interest of national security.” Id. § 1610(f)(3). And the",
        "paragraph_id": "para_99"
      },
      {
        "text": "President did so almost immediately, finding that attachments",
        "paragraph_id": "para_100"
      },
      {
        "text": "under section 1610(f) would “impede the ability of the",
        "paragraph_id": "para_101"
      },
      {
        "text": "President to conduct foreign policy.” See Determination to",
        "paragraph_id": "para_102"
      },
      {
        "text": "Waive Attachment Provisions Relating to Blocked Property of",
        "paragraph_id": "para_103"
      },
      {
        "text": "Terrorist-List States, 65 Fed. Reg. 66,483 (Oct. 28, 2000).",
        "paragraph_id": "para_104"
      },
      {
        "text": "Congress overrode the waiver by including another",
        "paragraph_id": "para_105"
      },
      {
        "text": "attachment provision in the Terrorism Risk Insurance Act of",
        "paragraph_id": "para_106"
      },
      {
        "text": "2002, Pub. L. 107-297, 116 Stat. 2322 (TRIA). See Ministry of",
        "paragraph_id": "para_107"
      },
      {
        "text": "Def. & Support for the Armed Forces of the Islamic Republic",
        "paragraph_id": "para_108"
      },
      {
        "text": "of Iran v. Elahi, 556 U.S. 366, 386 (2009). Section 201 of",
        "paragraph_id": "para_109"
      },
      {

      },
      {
        "text": "Notwithstanding any other provision of law, … in",
        "paragraph_id": "para_111"
      },
      {
        "text": "every case in which a person has obtained a judgment",
        "paragraph_id": "para_112"
      },
      {

      {
        "text": "party (including the blocked assets of any agency or",
        "paragraph_id": "para_116"
      },
      {
        "text": "instrumentality of that terrorist party) shall be subject",
        "paragraph_id": "para_117"
      },
      {
        "text": "to execution or attachment in aid of execution in order",
        "paragraph_id": "para_118"
      },
      {
        "text": "to satisfy such judgment to the extent of any",
        "paragraph_id": "para_119"
      },
      {
        "text": "compensatory damages for which such terrorist party",
        "paragraph_id": "para_120"
      },
      {
        "text": "has been adjudged liable.",
        "paragraph_id": "para_121"
      },
      {
        "text": "TRIA § 201(a). In sum, a foreign sovereign’s “blocked assets”",
        "paragraph_id": "para_122"
      },
      {
        "text": "are not immune from attachment by the holder of a terrorism-",
        "paragraph_id": "para_123"
      },
      {
        "text": "related judgment. TRIA defines a “blocked asset” as “any asset",
        "paragraph_id": "para_124"
      },
      {
        "text": "seized or frozen by the United States” under TWEA or IEEPA,",
        "paragraph_id": "para_125"
      },
      {
        "text": "id. § 201(d)(2)(A), but it excludes from the definition assets",
        "paragraph_id": "para_126"
      },
      {
        "text": "that are subject to certain licenses or used exclusively for",
        "paragraph_id": "para_127"
      },
      {
        "text": "diplomatic purposes, id. § 201(d)(2)(B). And it defines a",
        "paragraph_id": "para_128"
      },
      {
        "text": "“terrorist party” to include any foreign country designated as a",
        "paragraph_id": "para_129"
      },
      {
        "text": "state sponsor of terrorism. Id. § 201(d)(4). Where it applies,",
        "paragraph_id": "para_130"
      },
      {
        "text": "TRIA thus operates to abrogate the FSIA’s general immunity",
        "paragraph_id": "para_131"
      },
      {
        "text": "from execution and attachment that would otherwise protect",
        "paragraph_id": "para_132"
      },
      {
        "text": "the property of designated state sponsors of terrorism. Iran was",
        "paragraph_id": "para_133"
      },
      {
        "text": "so designated in 1984. See Determination Pursuant to Section",
        "paragraph_id": "para_134"
      },
      {
        "text": "6(i) of the Export Administration Act of 1979—Iran, 49 Fed.",
        "paragraph_id": "para_135"
      },
      {
        "text": "Reg. 2,836 (Jan. 23, 1984).",
        "paragraph_id": "para_136"
      },
      {
        "text": "D",
        "paragraph_id": "para_137"
      },
      {
        "text": "Plaintiffs with terrorism-related judgments against foreign",
        "paragraph_id": "para_138"
      },
      {
        "text": "sovereigns also may seek compensation from the United States",
        "paragraph_id": "para_139"
      },
      {
        "text": "Victims of State Sponsored Terrorism Fund. See 34 U.S.C.",
        "paragraph_id": "para_140"
      },
      {
        "text": "§ 20144(e)(1). Such plaintiffs may apply to the Victims Fund",
        "paragraph_id": "para_141"
      },
      {
        "text": "for compensation. See id. § 20144(c)(3)(A). The Fund then",
        "paragraph_id": "para_142"
      },
      {
        "text": "makes distributions to each eligible applicant on a pro rata basis",
        "paragraph_id": "para_143"
      },
      {
        "text": "up to a statutory cap. Id. § 20144(d)(3)(A)(i)–(ii).",
        "paragraph_id": "para_144"
      },
      {
        "text": "6",
        "paragraph_id": "para_145"
      },
      {
        "text": "Congress initially funded the Victims Fund with an",
        "paragraph_id": "para_146",
        "court_paragraph": 6
      },
      {
        "text": "appropriation. 34 U.S.C. § 20144(e)(5). But the Fund is now",
        "paragraph_id": "para_147"
      },
      {
        "text": "financed primarily by proceeds from enforcement actions",
        "paragraph_id": "para_148"
      },
      {
        "text": "under TWEA and IEEPA—including forfeiture actions against",
        "paragraph_id": "para_149"
      },
      {
        "text": "blocked assets. See id. § 20144(e)(2)(A)(i)–(ii).",
        "paragraph_id": "para_150"
      },
      {
        "text": "II",
        "paragraph_id": "para_151"
      },
      {
        "text": "This appeal involves two groups of plaintiffs holding",
        "paragraph_id": "para_152"
      },
      {
        "text": "terrorism-related judgments against Iran—the Owens and",
        "paragraph_id": "para_153"
      },
      {
        "text": "Levin plaintiffs. The Owens plaintiffs are owed almost a",
        "paragraph_id": "para_154"
      },
      {
        "text": "billion dollars on judgments arising from Al Qaeda’s 1998",
        "paragraph_id": "para_155"
      },
      {
        "text": "bombings of United States embassies in Kenya and Tanzania.",
        "paragraph_id": "para_156"
      },
      {
        "text": "The Levin plaintiffs are owed approximately $15 million on a",
        "paragraph_id": "para_157"
      },
      {
        "text": "judgment arising from the 1984 kidnapping and torture of",
        "paragraph_id": "para_158"
      },
      {
        "text": "Jeremy Levin by the Iran-backed terrorist group Hezbollah.",
        "paragraph_id": "para_159"
      },
      {
        "text": "Both groups seek to attach the same $9.98 million—which",
        "paragraph_id": "para_160"
      },
      {
        "text": "we call the “Funds”—to help execute their judgments. That",
        "paragraph_id": "para_161"
      },
      {
        "text": "money surfaced after Taif Mining Services tried to wire it to",
        "paragraph_id": "para_162"
      },
      {
        "text": "another foreign entity through Wells Fargo in New York. Taif",
        "paragraph_id": "para_163"
      },
      {
        "text": "was prohibited from doing so because it is a front company for",
        "paragraph_id": "para_164"
      },
      {
        "text": "the Iranian Revolutionary Guard Corps—an instrumentality of",
        "paragraph_id": "para_165"
      },
      {
        "text": "Iran and OFAC-designated sponsor of terrorism. See 31 C.F.R.",
        "paragraph_id": "para_166"
      },
      {
        "text": "§ 594.201(a)(5); Est. of Levin v. Wells Fargo Bank, N.A., 45",
        "paragraph_id": "para_167"
      },
      {
        "text": "F.4th 416, 417 (D.C. Cir. 2022) (Levin I). Alerted by OFAC,",
        "paragraph_id": "para_168"
      },
      {
        "text": "Wells Fargo halted the transfer of the Funds and placed the",
        "paragraph_id": "para_169"
      },
      {
        "text": "Funds in a South Dakota account. OFAC then issued an order",
        "paragraph_id": "para_170"
      },
      {
        "text": "memorializing that the Funds were blocked under section 203",
        "paragraph_id": "para_171"
      },
      {
        "text": "of IEEPA, Executive Order 13,224, and 31 C.F.R. § 594.201.",
        "paragraph_id": "para_172"
      },
      {
        "text": "After it blocked the Funds, the government moved to",
        "paragraph_id": "para_173"
      },
      {
        "text": "confiscate them by civil forfeiture. It filed an action against",
        "paragraph_id": "para_174"
      },
      {
        "text": "them in our district court, and the case was assigned to Chief",
        "paragraph_id": "para_175"
      },
      {
        "text": "Judge Boasberg. The government then sought a license from",
        "paragraph_id": "para_176"
      },
      {
        "text": "OFAC “for the purpose of perfecting civil in rem forfeiture of",
        "paragraph_id": "para_177"
      },
      {
        "text": "7",
        "paragraph_id": "para_178"
      },
      {
        "text": "the Blocked Funds pursuant to 18 U.S.C. § 981.” J.A. 287.",
        "paragraph_id": "para_179",
        "court_paragraph": 7
      },
      {
        "text": "OFAC granted the request, authorizing the government “to",
        "paragraph_id": "para_180"
      },
      {
        "text": "engage in all transactions necessary and ordinarily incident to",
        "paragraph_id": "para_181"
      },
      {
        "text": "effect the forfeiture” of the Funds. Id. at 291. It also authorized",
        "paragraph_id": "para_182"
      },
      {
        "text": "Wells Fargo to relinquish custody of the Funds, but only to the",
        "paragraph_id": "para_183"
      },
      {
        "text": "government, and only if the government “furnish[ed] a valid",
        "paragraph_id": "para_184"
      },
      {
        "text": "forfeiture order.” Id. Until then, OFAC’s license did not",
        "paragraph_id": "para_185"
      },
      {
        "text": "permit Wells Fargo to do anything with the Funds.",
        "paragraph_id": "para_186"
      },
      {
        "text": "While the government was taking steps toward forfeiture,",
        "paragraph_id": "para_187"
      },
      {
        "text": "a Wall Street Journal story brought the Funds to the attention",
        "paragraph_id": "para_188"
      },
      {
        "text": "of both plaintiff groups. See Sun & Tokar, U.S. Charges Two",
        "paragraph_id": "para_189"
      },
      {
        "text": "Iranians Over Oil Tanker Purchase, Seeking $12 Million",
        "paragraph_id": "para_190"
      },
      {
        "text": "Forfeiture, Wall St. J. (May 2, 2020), https://perma.cc/B75B-",
        "paragraph_id": "para_191"
      },
      {
        "text": "KMVT. Invoking TRIA, both groups moved for writs of",
        "paragraph_id": "para_192"
      },
      {
        "text": "attachment in the district court. In the Owens case, Judge Bates",
        "paragraph_id": "para_193"
      },
      {
        "text": "granted writs of attachment and then transferred the matter to",
        "paragraph_id": "para_194"
      },
      {
        "text": "Chief Judge Boasberg for coordination with the government’s",
        "paragraph_id": "para_195"
      },
      {
        "text": "civil-forfeiture action. In the Levin case, Judge Moss",
        "paragraph_id": "para_196"
      },
      {
        "text": "transferred the matter to Chief Judge Boasberg, who granted",
        "paragraph_id": "para_197"
      },
      {
        "text": "the writs but allowed the government to move to quash.",
        "paragraph_id": "para_198"
      },
      {
        "text": "The government moved to quash the Owens and Levin",
        "paragraph_id": "para_199"
      },
      {
        "text": "plaintiffs’ writs, and the district court granted the motion.",
        "paragraph_id": "para_200"
      },
      {
        "text": "Initially, it concluded that Iran lacked any property interest in",
        "paragraph_id": "para_201"
      },
      {
        "text": "the funds held by Wells Fargo. Levin v. Islamic Republic of",
        "paragraph_id": "para_202"
      },
      {
        "text": "Iran, 523 F. Supp. 3d 14, 21 (D.D.C. 2021). Reversing, we",
        "paragraph_id": "para_203"
      },
      {
        "text": "held that terrorist victims may attach blocked assets traceable",
        "paragraph_id": "para_204"
      },
      {
        "text": "to a terrorist owner and that the funds were “traceable to Taif",
        "paragraph_id": "para_205"
      },
      {
        "text": "and thus to Iran.” Levin I, 45 F.4th at 423 (cleaned up).",
        "paragraph_id": "para_206"
      },
      {
        "text": "On remand, the district court again granted the motions to",
        "paragraph_id": "para_207"
      },
      {
        "text": "quash. In relevant part, it offered two justifications. First,",
        "paragraph_id": "para_208"
      },
      {
        "text": "sovereign immunity barred the attachments. On this point, the",
        "paragraph_id": "para_209"
      },
      {
        "text": "court concluded that TRIA’s abrogation of immunity did not",
        "paragraph_id": "para_210"
      },
      {

        "paragraph_id": "para_211"
      },
      {
        "text": "apply because the Funds did not meet the statutory definition",
        "paragraph_id": "para_212",
        "court_paragraph": 8
      },
      {
        "text": "of “blocked assets.” Est. of Levin v. Wells Fargo Bank, N.A.,",
        "paragraph_id": "para_213"
      },
      {
        "text": "No. 21-cv-420, 2023 WL 3750577, at *6 (D.D.C. June 1,",
        "paragraph_id": "para_214"
      },
      {
        "text": "2023). Second, the court held that the government’s civil-",
        "paragraph_id": "para_215"
      },
      {
        "text": "forfeiture action independently foreclosed relief because, under",
        "paragraph_id": "para_216"
      },
      {
        "text": "the prior exclusive jurisdiction doctrine, that first-filed case",
        "paragraph_id": "para_217"
      },
      {
        "text": "barred all subsequent actions against the same property. Id. at",
        "paragraph_id": "para_218"
      },
      {
        "text": "*9. In closing, the district court also remarked that Congress’s",
        "paragraph_id": "para_219"
      },
      {
        "text": "decision to create the Victims Fund “cast heavy doubt” that it",
        "paragraph_id": "para_220"
      },
      {
        "text": "meant “to encourage a race to the courthouse by individual",
        "paragraph_id": "para_221"
      },
      {
        "text": "victims seeking to attach foreign funds that glance off the U.S.",
        "paragraph_id": "para_222"
      },
      {
        "text": "financial system.” Id. at *12.",
        "paragraph_id": "para_223"
      },
      {
        "text": "Both groups appealed. Our review is de novo. Bennett v.",
        "paragraph_id": "para_224"
      },
      {
        "text": "Islamic Republic of Iran, 618 F.3d 19, 21 (D.C. Cir. 2010).",
        "paragraph_id": "para_225"
      },
      {
        "text": "III",
        "paragraph_id": "para_226"
      },
      {
        "text": "Section 201(a) of TRIA makes the “blocked assets” of a",
        "paragraph_id": "para_227"
      },
      {
        "text": "“terrorist party” available to satisfy terrorism-related",
        "paragraph_id": "para_228"
      },
      {
        "text": "judgments against foreign sovereigns designated as state",
        "paragraph_id": "para_229"
      },
      {
        "text": "sponsors of terrorism. Levin I held that the Funds here are",
        "paragraph_id": "para_230"
      },
      {
        "text": "sufficiently traceable to Iran as a “terrorist party.” 45 F.4th at",
        "paragraph_id": "para_231"
      },
      {
        "text": "423–24. We now hold that the Funds are also “blocked assets.”",
        "paragraph_id": "para_232"
      },
      {
        "text": "A",
        "paragraph_id": "para_233"
      },
      {
        "text": "Section 201(d)(2)(A) of TRIA defines a “blocked asset” as",
        "paragraph_id": "para_234"
      },
      {
        "text": "“any asset seized or frozen by the United States” under TWEA",
        "paragraph_id": "para_235"
      },
      {
        "text": "or IEEPA. The statute then excludes from this definition two",
        "paragraph_id": "para_236"
      },
      {
        "text": "categories of property. The first covers any property that is",
        "paragraph_id": "para_237"
      },
      {
        "text": "“subject to a license … for final payment, transfer, or",
        "paragraph_id": "para_238"
      },
      {
        "text": "disposition by or to a person subject to the jurisdiction of the",
        "paragraph_id": "para_239"
      },
      {
        "text": "United States in connection with a transaction for which the",
        "paragraph_id": "para_240"
      },
      {
        "text": "issuance of such license has been specifically required by",
        "paragraph_id": "para_241"
      },
      {
        "text": "statute other than [IEEPA] or the United Nations Participation",
        "paragraph_id": "para_242"
      },
      {
        "text": "9",
        "paragraph_id": "para_243"
      },
      {
        "text": "Act” (Participation Act). Id. § 201(d)(2)(B)(i). The second",
        "paragraph_id": "para_244",
        "court_paragraph": 9
      },
      {
        "text": "exclusion covers property that is used for diplomatic purposes.",
        "paragraph_id": "para_245"
      },
      {
        "text": "Id. § 201(d)(2)(B)(ii).",
        "paragraph_id": "para_246"
      },
      {
        "text": "The Funds meet all the elements of this statutory",
        "paragraph_id": "para_247"
      },
      {
        "text": "definition. They are “frozen” because the OFAC blocking",
        "paragraph_id": "para_248"
      },
      {
        "text": "order provides that they “may not be transferred, paid,",
        "paragraph_id": "para_249"
      },
      {
        "text": "exported, withdrawn, or otherwise dealt in without prior",
        "paragraph_id": "para_250"
      },
      {
        "text": "authorization from OFAC.” J.A. 271. In other words, the",
        "paragraph_id": "para_251"
      },
      {
        "text": "Funds may do nothing but sit in a bank account. Moreover,",
        "paragraph_id": "para_252"
      },
      {
        "text": "OFAC imposed the freeze pursuant to IEEPA. The license",
        "paragraph_id": "para_253"
      },
      {
        "text": "exception does not apply because the license itself was required",
        "paragraph_id": "para_254"
      },
      {
        "text": "by IEEPA, not by a statute “other than” IEEPA or the",
        "paragraph_id": "para_255"
      },
      {
        "text": "Participation Act. And nobody contends that the exception for",
        "paragraph_id": "para_256"
      },
      {
        "text": "diplomatic property applies.",
        "paragraph_id": "para_257"
      },
      {
        "text": "B",
        "paragraph_id": "para_258"
      },
      {
        "text": "The government responds that the Funds are not a",
        "paragraph_id": "para_259"
      },
      {
        "text": "“blocked asset” because they are not “frozen.” We disagree.",
        "paragraph_id": "para_260"
      },
      {
        "text": "1",
        "paragraph_id": "para_261"
      },
      {
        "text": "The government contends that an asset is frozen only if it",
        "paragraph_id": "para_262",
        "court_paragraph": 1
      },
      {
        "text": "is fully immobilized. And it says that the Funds are not fully",
        "paragraph_id": "para_263"
      },
      {
        "text": "immobilized because OFAC has issued a license authorizing",
        "paragraph_id": "para_264"
      },
      {
        "text": "the government to seek their forfeiture.",
        "paragraph_id": "para_265"
      },
      {
        "text": "This argument likely falters at its major premise. In both",
        "paragraph_id": "para_266"
      },
      {
        "text": "ordinary and legal parlance, an asset is frozen if it is difficult to",
        "paragraph_id": "para_267"
      },
      {
        "text": "convert into cash. See Frozen asset, Webster’s New",
        "paragraph_id": "para_268"
      },
      {
        "text": "International Dictionary 915 (3d ed. 1961) (“an asset that",
        "paragraph_id": "para_269"
      },
      {
        "text": "cannot readily be turned into cash without heavy loss”); Asset,",
        "paragraph_id": "para_270"
      },
      {
        "text": "Black’s Law Dictionary (12th ed. 2024) (defining “frozen",
        "paragraph_id": "para_271"
      },
      {
        "text": "asset” as “[a]n asset that is difficult to convert into cash because",
        "paragraph_id": "para_272"
      },
      {
        "text": "of court order or other legal process”). That suggests an asset",
        "paragraph_id": "para_273"
      },
      {
        "text": "10",

      },
      {
        "text": "is frozen if it is subject to a significant restriction; the restriction",
        "paragraph_id": "para_275",
        "court_paragraph": 10
      },
      {
        "text": "need not be fully immobilizing.",
        "paragraph_id": "para_276"
      },
      {
        "text": "In any event, the Funds are fully immobilized despite the",
        "paragraph_id": "para_277"
      },
      {
        "text": "forfeiture license. The license does just two things. First, it",
        "paragraph_id": "para_278"
      },
      {
        "text": "permits courts to enter orders in forfeiture proceedings",
        "paragraph_id": "para_279"
      },
      {
        "text": "respecting the Funds. See Forfeiture License §§ 1(a), 3(a)–(b),",
        "paragraph_id": "para_280"
      },
      {
        "text": "J.A. 291. Second, it permits Wells Fargo to relinquish custody",
        "paragraph_id": "para_281"
      },
      {
        "text": "of the Funds to the government if the government obtains a",
        "paragraph_id": "para_282"
      },
      {
        "text": "valid forfeiture order. See id. §§ 1(b), 2, J.A. 291. But the",
        "paragraph_id": "para_283"
      },
      {
        "text": "government has not yet obtained a forfeiture order, so for the",
        "paragraph_id": "para_284"
      },
      {
        "text": "time being, all dealing in the Funds is prohibited—they must",
        "paragraph_id": "para_285"
      },
      {
        "text": "remain in a Wells Fargo account. See 31 C.F.R. § 594.502(c)",
        "paragraph_id": "para_286"
      },
      {
        "text": "(a license removes a prohibition “only to the extent specifically",
        "paragraph_id": "para_287"
      },
      {
        "text": "stated by its terms”). In other words, the license does not",
        "paragraph_id": "para_288"
      },
      {
        "text": "unfreeze the Funds.",
        "paragraph_id": "para_289"
      },
      {
        "text": "Arguing even more broadly, the government contends that",
        "paragraph_id": "para_290"
      },
      {
        "text": "any OFAC license authorizing any use unfreezes otherwise",
        "paragraph_id": "para_291"
      },
      {
        "text": "blocked funds. We see no textual support for that",
        "paragraph_id": "para_292"
      },
      {
        "text": "interpretation. For one thing, it runs headlong into the ordinary",
        "paragraph_id": "para_293"
      },
      {
        "text": "and legal meaning of frozen asset, as explained above. And it",
        "paragraph_id": "para_294"
      },
      {
        "text": "is implausible in light of TRIA’s historical context. Congress",
        "paragraph_id": "para_295"
      },
      {
        "text": "enacted section 201 in response to the President’s waiver of 28",
        "paragraph_id": "para_296"
      },
      {
        "text": "U.S.C. § 1610(f). The whole point of section 201 was to",
        "paragraph_id": "para_297"
      },
      {
        "text": "eliminate the President’s discretion to prevent victims of state-",
        "paragraph_id": "para_298"
      },
      {
        "text": "sponsored terrorism from attaching blocked assets. See Elahi,",
        "paragraph_id": "para_299"
      },
      {
        "text": "556 U.S. at 386. If the government were right, then section 201",
        "paragraph_id": "para_300"
      },
      {
        "text": "would not prevent the very mischief that Congress sought to",
        "paragraph_id": "para_301"
      },
      {
        "text": "address—that provision would allow the Executive to thwart",
        "paragraph_id": "para_302"
      },
      {
        "text": "attachment of blocked assets simply by authorizing itself to",
        "paragraph_id": "para_303"
      },
      {
        "text": "initiate forfeiture proceedings.",
        "paragraph_id": "para_304"
      },
      {
        "text": "Structural considerations reinforce this conclusion. The",
        "paragraph_id": "para_305"
      },
      {
        "text": "license exception excludes from the definition of “blocked",
        "paragraph_id": "para_306"
      },
      {
        "text": "11",

      },
      {
        "text": "asset” property that is subject to specific kinds of licenses",
        "paragraph_id": "para_308",
        "court_paragraph": 11
      },
      {
        "text": "required by specific statutory authorities. TRIA",
        "paragraph_id": "para_309"
      },
      {
        "text": "§ 201(d)(2)(B)(i). That exception would be puzzling if the",
        "paragraph_id": "para_310"
      },
      {
        "text": "government were right that other kinds of licenses required by",
        "paragraph_id": "para_311"
      },
      {
        "text": "other statutory authorities could have the same practical effect",
        "paragraph_id": "para_312"
      },
      {
        "text": "by making the relevant asset no longer “frozen” or “blocked.”",
        "paragraph_id": "para_313"
      },
      {
        "text": "In that instance, Congress would have had little reason to",
        "paragraph_id": "para_314"
      },
      {
        "text": "specify which licenses fall within the exception. See Esteras v.",
        "paragraph_id": "para_315"
      },
      {
        "text": "United States, 145 S. Ct. 2031, 2040–41 (2025) (negative-",
        "paragraph_id": "para_316"
      },
      {
        "text": "implication canon). Moreover, the exception would be even",
        "paragraph_id": "para_317"
      },
      {
        "text": "more puzzling if the government were right that any license",
        "paragraph_id": "para_318"
      },
      {
        "text": "operates to un-freeze and un-block assets for TRIA purposes.",
        "paragraph_id": "para_319"
      },
      {
        "text": "In that instance, the license exception—with all of its",
        "paragraph_id": "para_320"
      },
      {
        "text": "qualifications regarding the covered kinds of licenses and",
        "paragraph_id": "para_321"
      },
      {
        "text": "statutory authorities—would be surprisingly reduced to",
        "paragraph_id": "para_322"
      },
      {
        "text": "surplusage. See Reiter v. Sonotone Corp., 442 U.S. 330, 339",
        "paragraph_id": "para_323"
      },
      {
        "text": "(1979) (canon against surplusage).",
        "paragraph_id": "para_324"
      },
      {

        "text": "OFAC has blocking and licensing authority under statutes",
        "paragraph_id": "para_326"
      },
      {
        "text": "besides TWEA and IEEPA, such as the Foreign Narcotics",
        "paragraph_id": "para_327"
      },
      {
        "text": "Kingpin Designation Act, 21 U.S.C. § 1904(b). The",
        "paragraph_id": "para_328"
      },
      {
        "text": "government contends that the license exception can therefore",
        "paragraph_id": "para_329"
      },
      {
        "text": "do meaningful work even if any TWEA or IEEPA license un-",
        "paragraph_id": "para_330"
      },
      {
        "text": "freezes and un-blocks the relevant asset. The government asks",
        "paragraph_id": "para_331"
      },
      {
        "text": "us to imagine an asset simultaneously blocked under IEEPA",
        "paragraph_id": "para_332"
      },
      {
        "text": "and the Kingpin Act. As the government explains, if the",
        "paragraph_id": "para_333"
      },
      {
        "text": "government licensed transactions under its Kingpin Act",
        "paragraph_id": "para_334"
      },
      {
        "text": "authority but not under its IEEPA authority, then TRIA’s",
        "paragraph_id": "para_335"
      },
      {
        "text": "license exception would operate to un-block the asset for TRIA",
        "paragraph_id": "para_336"
      },
      {
        "text": "purposes. And so, the government concludes, the license",
        "paragraph_id": "para_337"
      },
      {
        "text": "exception does meaningful work even under its narrow reading",
        "paragraph_id": "para_338"
      },
      {
        "text": "of “blocked” and “frozen.”",
        "paragraph_id": "para_339"
      },
      {
        "text": "12",
        "paragraph_id": "para_340"
      },
      {
        "text": "This account has several difficulties. To begin with,",
        "paragraph_id": "para_341",
        "court_paragraph": 12
      },
      {
        "text": "TRIA’s text suggests that Congress envisioned OFAC would",
        "paragraph_id": "para_342"
      },
      {
        "text": "license specific transactions rather than remove statutory",
        "paragraph_id": "para_343"
      },
      {
        "text": "blocks one-by-one. Its license exception covers “property”",
        "paragraph_id": "para_344"
      },
      {
        "text": "subject to a license “for final payment, transfer, or disposition”",
        "paragraph_id": "para_345"
      },
      {
        "text": "in connection with a transaction that requires a license. TRIA",
        "paragraph_id": "para_346"
      },
      {
        "text": "§ 201(d)(2)(A). If a license merely removed one of multiple",
        "paragraph_id": "para_347"
      },
      {
        "text": "overlapping statutory blocks on an asset, it would not actually",
        "paragraph_id": "para_348"
      },
      {
        "text": "authorize a transaction finally transferring or disposing of that",
        "paragraph_id": "para_349"
      },
      {
        "text": "property. Moreover, the government offers no explanation for",
        "paragraph_id": "para_350"
      },
      {
        "text": "why Congress would focus on the unblocking of assets in this",
        "paragraph_id": "para_351"
      },
      {
        "text": "piecemeal fashion. And the record before us suggests that",
        "paragraph_id": "para_352"
      },
      {
        "text": "OFAC keys licenses to particular transactions, without regard",
        "paragraph_id": "para_353"
      },
      {
        "text": "for the particular statute or statutes supporting the block. See",
        "paragraph_id": "para_354"
      },
      {
        "text": "Forfeiture License, § 1(a), J.A. 291 (licensing the government",
        "paragraph_id": "para_355"
      },
      {
        "text": "“to engage in [certain] transactions,” without specifically",
        "paragraph_id": "para_356"
      },
      {
        "text": "mentioning IEEPA); see also J.A. 290 (granting the license",
        "paragraph_id": "para_357"
      },
      {
        "text": "“under the authority of one or more” statutes and regulatory",
        "paragraph_id": "para_358"
      },
      {
        "text": "provisions, without specifying which). Furthermore,",
        "paragraph_id": "para_359"
      },
      {
        "text": "regardless of whether the government’s interpretation of",
        "paragraph_id": "para_360"
      },
      {
        "text": "“frozen” would reduce the license exception entirely to",
        "paragraph_id": "para_361"
      },
      {
        "text": "surplusage, or would simply render it implausibly narrow, that",
        "paragraph_id": "para_362"
      },
      {
        "text": "structural consideration cuts against its proposed interpretation.",
        "paragraph_id": "para_363"
      },
      {
        "text": "See Mackey v. Lanier Collection Agency & Serv., Inc., 486 U.S.",
        "paragraph_id": "para_364"
      },
      {
        "text": "825, 837 (1988). And finally, the government’s account at",
        "paragraph_id": "para_365"
      },
      {
        "text": "most responds to the structural argument that its interpretation",
        "paragraph_id": "para_366"
      },
      {
        "text": "of “frozen” makes the license requirement implausibly narrow.",
        "paragraph_id": "para_367"
      },
      {
        "text": "This does not undercut the frontline textual argument regarding",
        "paragraph_id": "para_368"
      },
      {
        "text": "the plain meaning of frozen asset.",
        "paragraph_id": "para_369"
      },
      {
        "text": "For these reasons, we conclude that a highly restrictive",
        "paragraph_id": "para_370"
      },
      {
        "text": "license like the one at issue here does not make TRIA",
        "paragraph_id": "para_371"
      },
      {
        "text": "inapplicable. The Funds remain “frozen” and thus “blocked.”",
        "paragraph_id": "para_372"
      },
      {
        "text": "And because the relevant license was not required under a",
        "paragraph_id": "para_373"
      },
      {

      },
      {
        "text": "statute “other than” IEEPA or the Participation Act, the license",
        "paragraph_id": "para_375",
        "court_paragraph": 13
      },
      {
        "text": "exception does not apply.",
        "paragraph_id": "para_376"
      },
      {

        "paragraph_id": "para_377"
      },
      {
        "text": "The government also invokes precedent, primarily three",
        "paragraph_id": "para_378",
        "court_paragraph": 2
      },
      {
        "text": "circuit decisions. With respect, we find the cited authorities",
        "paragraph_id": "para_379"
      },
      {
        "text": "either inapposite or unpersuasive.",
        "paragraph_id": "para_380"
      },
      {
        "text": "First, the government cites Bank of New York v. Rubin, 484",
        "paragraph_id": "para_381"
      },
      {
        "text": "F.3d 149 (2d Cir. 2007), where the Second Circuit endorsed the",
        "paragraph_id": "para_382"
      },
      {
        "text": "reasoning in Weinstein v. Islamic Republic of Iran, 299",
        "paragraph_id": "para_383"
      },
      {
        "text": "F. Supp. 2d 63 (E.D.N.Y. 2004). See 484 F.3d at 150. In",
        "paragraph_id": "para_384"
      },
      {
        "text": "Weinstein, a district court held that the relevant accounts were",
        "paragraph_id": "para_385"
      },
      {
        "text": "not “frozen” under TRIA because the OFAC orders at issue",
        "paragraph_id": "para_386"
      },
      {
        "text": "allowed the assets’ owners to retrieve their funds under certain",
        "paragraph_id": "para_387"
      },
      {
        "text": "conditions. See 299 F. Supp. 2d at 73–74. Weinstein stands for",
        "paragraph_id": "para_388"
      },
      {
        "text": "the obvious proposition that not every IEEPA restriction",
        "paragraph_id": "para_389"
      },
      {
        "text": "freezes an asset. In particular, if OFAC allows the owner of an",
        "paragraph_id": "para_390"
      },
      {
        "text": "asset to withdraw it from the United States, the asset is easily",
        "paragraph_id": "para_391"
      },
      {
        "text": "converted into cash and thus not frozen. See id. at 74;",
        "paragraph_id": "para_392"
      },
      {
        "text": "Webster’s, supra, at 915 (defining “frozen asset”). That point",
        "paragraph_id": "para_393"
      },
      {
        "text": "hardly supports the government’s position that any license",
        "paragraph_id": "para_394"
      },
      {
        "text": "unfreezes an asset, no matter how restrictive.",
        "paragraph_id": "para_395"
      },
      {
        "text": "The second case is United States v. Holy Land Foundation",
        "paragraph_id": "para_396"
      },
      {
        "text": "for Relief & Development, 722 F.3d 677 (5th Cir. 2013). Holy",
        "paragraph_id": "para_397"
      },
      {
        "text": "Land involved assets blocked by IEEPA and the criminal-",
        "paragraph_id": "para_398"
      },
      {
        "text": "forfeiture statute, 21 U.S.C. § 853(e)(1)(A), which allows the",
        "paragraph_id": "para_399"
      },
      {
        "text": "government to restrain assets pending criminal-forfeiture",
        "paragraph_id": "para_400"
      },
      {
        "text": "proceedings. See 722 F.3d at 681–82. The government sought",
        "paragraph_id": "para_401"
      },
      {
        "text": "and obtained an OFAC license to allow it to pursue the",
        "paragraph_id": "para_402"
      },
      {
        "text": "forfeiture. Id. at 682. The plaintiffs held terrorism-related",
        "paragraph_id": "para_403"
      },
      {
        "text": "judgments against the owners of the blocked funds, and they",
        "paragraph_id": "para_404"
      },
      {
        "text": "invoked TRIA to attach the assets. Id. The district court issued",
        "paragraph_id": "para_405"
      },
      {
        "text": "a writ of attachment, but the Fifth Circuit reversed. Without",
        "paragraph_id": "para_406"
      },
      {

        "paragraph_id": "para_407"
      },
      {
        "text": "textual analysis or citations to precedent, the Fifth Circuit",
        "paragraph_id": "para_408",
        "court_paragraph": 14
      },
      {
        "text": "stated that TRIA does not “reach those funds which the",
        "paragraph_id": "para_409"
      },
      {
        "text": "government has been given authorization to control through",
        "paragraph_id": "para_410"
      },
      {
        "text": "another means” such as the criminal-forfeiture statute. Id. at",
        "paragraph_id": "para_411"
      },
      {
        "text": "685. But an asset may be “frozen” and thus “blocked” under",
        "paragraph_id": "para_412"
      },
      {
        "text": "IEEPA even if some other statute allows particular uses or",
        "paragraph_id": "para_413"
      },
      {
        "text": "transactions for the funds. And although section 853 authorizes",
        "paragraph_id": "para_414"
      },
      {
        "text": "both asset blocks and criminal-forfeiture proceedings against",
        "paragraph_id": "para_415"
      },
      {
        "text": "the blocked assets, it does not displace the IEEPA block. To",
        "paragraph_id": "para_416"
      },
      {
        "text": "do that, the government in Holy Land needed to obtain an",
        "paragraph_id": "para_417"
      },
      {
        "text": "IEEPA license. See id. at 687. Moreover, even after the license",
        "paragraph_id": "para_418"
      },
      {
        "text": "issued, the IEEPA block still prevented all dealing in the funds",
        "paragraph_id": "para_419"
      },
      {
        "text": "unless and until a court entered a final forfeiture order. See id.",
        "paragraph_id": "para_420"
      },
      {
        "text": "(noting that the license allowed the forfeiture process to",
        "paragraph_id": "para_421"
      },
      {
        "text": "proceed “[n]otwithstanding the status of [the] assets as",
        "paragraph_id": "para_422"
      },
      {
        "text": "blocked”). That means the funds were still “frozen” and thus",
        "paragraph_id": "para_423"
      },
      {
        "text": "“blocked” within the meaning of TRIA. And because the",
        "paragraph_id": "para_424"
      },
      {
        "text": "license obtained was not “required by a statute other than”",
        "paragraph_id": "para_425"
      },
      {
        "text": "IEEPA, the license exception did not apply. See TRIA",
        "paragraph_id": "para_426"
      },
      {
        "text": "§ 201(d)(2)(B)(i).",
        "paragraph_id": "para_427"
      },
      {
        "text": "The government’s final case is United States v. All Funds",
        "paragraph_id": "para_428"
      },
      {
        "text": "on Deposit with R.J. O’Brien & Associates, 783 F.3d 607 (7th",
        "paragraph_id": "para_429"
      },
      {
        "text": "Cir. 2015). There, the Seventh Circuit held that plaintiffs could",
        "paragraph_id": "para_430"
      },
      {
        "text": "not use TRIA to attach IEEPA-blocked funds because OFAC",
        "paragraph_id": "para_431"
      },
      {
        "text": "had licensed the government to pursue civil forfeiture against",
        "paragraph_id": "para_432"
      },
      {
        "text": "them. The court relied primarily on TRIA’s license exception.",
        "paragraph_id": "para_433"
      },
      {
        "text": "It reasoned that because the funds at issue were subject to a",
        "paragraph_id": "para_434"
      },
      {
        "text": "civil-forfeiture license, which is “a license for final transfer or",
        "paragraph_id": "para_435"
      },
      {
        "text": "disposition,” the license exception carved them out from",
        "paragraph_id": "para_436"
      },
      {
        "text": "TRIA’s definition of “blocked assets.” Id. at 624. But again,",
        "paragraph_id": "para_437"
      },
      {
        "text": "the license exception by its terms applies only if assets are",
        "paragraph_id": "para_438"
      },
      {
        "text": "subject to a license “required by a statute other than” IEEPA or",
        "paragraph_id": "para_439"
      },
      {
        "text": "the Participation Act. See TRIA § 201(d)(2)(B)(i). As Judge",
        "paragraph_id": "para_440"
      },
      {
        "text": "Manion explained, only IEEPA required the government to",
        "paragraph_id": "para_441"
      },
      {

      {
        "text": "seek the license in question, so the license did not unblock the",
        "paragraph_id": "para_443",
        "court_paragraph": 15

      {

      },
      {
        "text": "dissenting in relevant part).",

      },
      {

      {
        "text": "Because the Funds fall within TRIA’s definition of a",
        "paragraph_id": "para_447"
      },
      {
        "text": "“blocked asset,” section 201 of TRIA applies and abrogates",
        "paragraph_id": "para_448"
      },
      {
        "text": "what would otherwise be Iran’s sovereign immunity from",
        "paragraph_id": "para_449"
      },
      {
        "text": "attachment in aid of execution of the plaintiffs’ judgments.",
        "paragraph_id": "para_450"
      },
      {
        "text": "IV",
        "paragraph_id": "para_451"
      },
      {
        "text": "The district court further held that the prior exclusive",
        "paragraph_id": "para_452"
      },
      {
        "text": "jurisdiction doctrine independently bars attachment of the",
        "paragraph_id": "para_453"
      },
      {
        "text": "Funds. That doctrine seeks to prevent multiple in rem",
        "paragraph_id": "para_454"
      },
      {
        "text": "proceedings against the same property at the same time. We",
        "paragraph_id": "para_455"
      },
      {
        "text": "hold that the doctrine does not apply to proceedings, like the",
        "paragraph_id": "para_456"
      },
      {
        "text": "competing forfeiture and attachment matters here, filed in the",
        "paragraph_id": "para_457"
      },
      {
        "text": "same court.",
        "paragraph_id": "para_458"
      },
      {
        "text": "The prior exclusive jurisdiction doctrine is an “ancient and",
        "paragraph_id": "para_459"
      },
      {
        "text": "oft-repeated rule” of in rem and quasi in rem jurisdiction. 16",
        "paragraph_id": "para_460"
      },
      {
        "text": "C. Wright & A. Miller, Federal Practice and Procedure § 3631",
        "paragraph_id": "para_461"
      },
      {
        "text": "(3d ed. 2025). It provides that “when a state or federal court of",
        "paragraph_id": "para_462"
      },
      {
        "text": "competent jurisdiction has obtained possession, custody, or",
        "paragraph_id": "para_463"
      },
      {
        "text": "control of particular property, that authority and power over the",
        "paragraph_id": "para_464"
      },
      {
        "text": "property may not be disturbed by any other court.” Id. So",
        "paragraph_id": "para_465"
      },
      {
        "text": "when two in rem actions are filed against the same property in",
        "paragraph_id": "para_466"
      },
      {
        "text": "different courts, only one “court, or its officer” may possess or",
        "paragraph_id": "para_467"
      },
      {
        "text": "control “the property which is the subject of the litigation.”",
        "paragraph_id": "para_468"
      },
      {
        "text": "Princess Lida of Thurn & Taxis v. Thompson, 305 U.S. 456,",
        "paragraph_id": "para_469"
      },
      {
        "text": "466 (1939). Thus “the jurisdiction of the one court must yield",
        "paragraph_id": "para_470"
      },
      {
        "text": "to that of the other.” Id. In sum, only one court at a time may",
        "paragraph_id": "para_471"
      },
      {
        "text": "exercise jurisdiction over particular property.",
        "paragraph_id": "para_472"
      },
      {
        "text": "16",

      },
      {
        "text": "On that understanding, the prior exclusive jurisdiction",
        "paragraph_id": "para_474",
        "court_paragraph": 16
      },
      {
        "text": "doctrine does not apply here. This case involves three",
        "paragraph_id": "para_475"
      },
      {
        "text": "competing in rem actions filed against the same property—one",
        "paragraph_id": "para_476"
      },
      {
        "text": "civil-forfeiture action and two attachment proceedings under",
        "paragraph_id": "para_477"
      },
      {
        "text": "TRIA. But all three were filed in the same court—the District",
        "paragraph_id": "para_478"
      },
      {
        "text": "Court for the District of Columbia. The cases thus present no",
        "paragraph_id": "para_479"
      },
      {
        "text": "problem of multiple courts simultaneously exercising",
        "paragraph_id": "para_480"
      },
      {
        "text": "jurisdiction over the same property.",
        "paragraph_id": "para_481"
      },
      {
        "text": "The government objects that the prior exclusive",
        "paragraph_id": "para_482"
      },
      {
        "text": "jurisdiction doctrine does more than simply prevent",
        "paragraph_id": "para_483"
      },
      {
        "text": "jurisdictional conflicts between courts. It contends that once a",
        "paragraph_id": "para_484"
      },
      {
        "text": "suit involving particular property is filed, the doctrine bars any",
        "paragraph_id": "para_485"
      },
      {
        "text": "other suit involving the same property. The government thus",
        "paragraph_id": "para_486"
      },
      {
        "text": "seeks to apply the doctrine to competing lawsuits filed before",
        "paragraph_id": "para_487"
      },
      {
        "text": "different judges, even if they all serve on the same court. The",
        "paragraph_id": "para_488"
      },
      {
        "text": "government is mistaken.",
        "paragraph_id": "para_489"
      },
      {
        "text": "A",
        "paragraph_id": "para_490"
      },
      {
        "text": "The prior exclusive jurisdiction doctrine is “based upon",
        "paragraph_id": "para_491"
      },
      {
        "text": "necessity.” Kline v. Burke Constr. Co., 260 U.S. 226, 235",
        "paragraph_id": "para_492"
      },
      {
        "text": "(1922). So it does not apply “where the necessity, actual or",
        "paragraph_id": "para_493"
      },
      {
        "text": "potential, does not exist.” Id. Thus, the scope of the doctrine",
        "paragraph_id": "para_494"
      },
      {
        "text": "turns on what problem it exists to solve.",
        "paragraph_id": "para_495"
      },
      {
        "text": "Here is the problem: A court cannot proceed in a suit",
        "paragraph_id": "para_496"
      },
      {
        "text": "involving particular property without seizing the property. See,",
        "paragraph_id": "para_497"
      },
      {
        "text": "e.g., Republic Nat’l Bank of Mia. v. United States, 506 U.S. 80,",
        "paragraph_id": "para_498"
      },
      {
        "text": "84 (1992) (“It long has been understood that a valid seizure of",
        "paragraph_id": "para_499"
      },
      {
        "text": "the res is a prerequisite to the initiation of an in rem …",
        "paragraph_id": "para_500"
      },
      {
        "text": "proceeding.” (cleaned up)). So one court hearing an in rem",
        "paragraph_id": "para_501"
      },
      {
        "text": "action must seize the property against which it is directed. And",
        "paragraph_id": "para_502"
      },
      {
        "text": "a second court could not hear an in rem action against the same",
        "paragraph_id": "para_503"
      },
      {
        "text": "property without seizing it from the first, which would create",
        "paragraph_id": "para_504"
      },
      {
        "text": "“unseemly conflicts between courts whose jurisdiction",
        "paragraph_id": "para_505"
      },
      {
        "text": "17",
        "paragraph_id": "para_506"
      },
      {
        "text": "embraces the same subject.” Kline, 260 U.S. at 231; see Penn",
        "paragraph_id": "para_507",
        "court_paragraph": 17
      },
      {
        "text": "Gen. Cas. Co. v. Commonwealth of Pa. ex rel. Schnader, 294",
        "paragraph_id": "para_508"
      },
      {
        "text": "U.S. 189, 195 (1935). No such conflicts arise when multiple",
        "paragraph_id": "para_509"
      },
      {
        "text": "suits are filed in the same court. In that instance, the court takes",
        "paragraph_id": "para_510"
      },
      {
        "text": "control of the property by virtue of the first-filed suit. And later",
        "paragraph_id": "para_511"
      },
      {
        "text": "suits merely ask the court to consider further claims against it.",
        "paragraph_id": "para_512"
      },
      {
        "text": "The Supreme Court suggested as much in Hagan v. Lucas,",
        "paragraph_id": "para_513"
      },
      {
        "text": "35 U.S. (10 Pet.) 400 (1836). That case arose after a federal",
        "paragraph_id": "para_514"
      },
      {
        "text": "court directed a marshal to seize property that a sheriff had",
        "paragraph_id": "para_515"
      },
      {
        "text": "levied pursuant to a state court order. Id. at 401. The Supreme",
        "paragraph_id": "para_516"
      },
      {
        "text": "Court deemed the federal seizure order invalid. It reasoned that",
        "paragraph_id": "para_517"
      },
      {
        "text": "the prior exclusive jurisdiction doctrine prevents a court from",
        "paragraph_id": "para_518"
      },
      {
        "text": "attaching property already seized by a different court. Id. at",
        "paragraph_id": "para_519"
      },
      {
        "text": "403. It explained that “[t]he first levy, whether it were made",
        "paragraph_id": "para_520"
      },
      {
        "text": "under the federal or state authority, withdraws the property",
        "paragraph_id": "para_521"
      },
      {
        "text": "from the reach of the process of the other.” Id. At the same",
        "paragraph_id": "para_522"
      },
      {
        "text": "time, however, the Court also observed that the first levy does",
        "paragraph_id": "para_523"
      },
      {
        "text": "not withdraw the property from the reach of the process of the",
        "paragraph_id": "para_524"
      },
      {
        "text": "same court. Id. For even after a sheriff seizes property",
        "paragraph_id": "para_525"
      },
      {
        "text": "pursuant to a writ of attachment, a judge or sheriff in the same",
        "paragraph_id": "para_526"
      },
      {
        "text": "“jurisdiction” may issue additional writs of attachment or",
        "paragraph_id": "para_527"
      },
      {
        "text": "execution against that property. Id. In other words, the prior",
        "paragraph_id": "para_528"
      },
      {
        "text": "exclusive jurisdiction doctrine does not prevent a single court",
        "paragraph_id": "para_529"
      },
      {
        "text": "from presiding over multiple suits involving the same property.",
        "paragraph_id": "para_530"
      },
      {
        "text": "B",
        "paragraph_id": "para_531"
      },
      {
        "text": "The government argues that the prior exclusive",
        "paragraph_id": "para_532"
      },
      {
        "text": "jurisdiction doctrine exists to prevent not only jurisdictional",
        "paragraph_id": "para_533"
      },
      {
        "text": "conflicts arising when cases are filed, but also inconsistent",
        "paragraph_id": "para_534"
      },
      {
        "text": "judgments when they are adjudicated. The government reasons",
        "paragraph_id": "para_535"
      },
      {
        "text": "that district judges within a single court are not bound by each",
        "paragraph_id": "para_536"
      },
      {
        "text": "other’s rulings, just as district judges on different courts do not",
        "paragraph_id": "para_537"
      },
      {
        "text": "bind one another. So, it concludes, the prior exclusive",
        "paragraph_id": "para_538"
      },
      {
        "text": "18",

      },
      {
        "text": "jurisdiction doctrine must foreclose multiple in rem",
        "paragraph_id": "para_540",
        "court_paragraph": 18
      },
      {
        "text": "proceedings even within the same court.",
        "paragraph_id": "para_541"
      },
      {
        "text": "The government’s view has little to recommend it. For one",

        "text": "thing, we have found no case applying the doctrine in this way;",
        "paragraph_id": "para_543"
      },
      {
        "text": "the cases cited by the government involve actual or potential",
        "paragraph_id": "para_544"
      },
      {
        "text": "conflicts between state and federal courts. See United States v.",
        "paragraph_id": "para_545"
      },
      {
        "text": "Bank of N.Y. & Tr. Co., 296 U.S. 463, 478 (1936); Hammer v.",
        "paragraph_id": "para_546"
      },
      {
        "text": "HHS, 905 F.3d 517, 536 (7th Cir. 2018). Moreover, rules of",
        "paragraph_id": "para_547"
      },
      {
        "text": "claim and issue preclusion prevent conflicting judgments. See",
        "paragraph_id": "para_548"
      },
      {
        "text": "Restatement (Second) of Judgments § 30 (1982). And the",
        "paragraph_id": "para_549"
      },
      {
        "text": "concern that there would be unseemly competition between",
        "paragraph_id": "para_550"
      },
      {
        "text": "judges of the same court strikes us as unrealistic. In the main,",
        "paragraph_id": "para_551"
      },
      {
        "text": "local rules will funnel cases involving the same property to the",
        "paragraph_id": "para_552"
      },
      {
        "text": "same district judge. Here, for example, Judge Bates and Judge",
        "paragraph_id": "para_553"
      },
      {
        "text": "Moss invoked D.D.C. Local Rule 40.5 to transfer their",
        "paragraph_id": "para_554"
      },
      {
        "text": "respective TRIA attachment cases to Chief Judge Boasberg,",
        "paragraph_id": "para_555"
      },
      {
        "text": "who was already presiding over the government’s first-filed",
        "paragraph_id": "para_556"
      },
      {
        "text": "forfeiture action. And with all three cases before a single judge,",
        "paragraph_id": "para_557"
      },
      {
        "text": "there is no need to allow only the first-filed case to be",
        "paragraph_id": "para_558"
      },
      {
        "text": "considered.1",
        "paragraph_id": "para_559"
      },
      {
        "text": "1 The government hints at an argument that the civil-forfeiture",
        "paragraph_id": "para_560"
      },
      {
        "text": "statute bars the attachment proceedings here. In relevant part, that",
        "paragraph_id": "para_561"
      },
      {
        "text": "statute provides that property “taken or detained [by civil forfeiture]",
        "paragraph_id": "para_562"
      },
      {
        "text": "shall not be repleviable, but shall be deemed to be in the custody of",
        "paragraph_id": "para_563"
      },
      {
        "text": "the [government], subject only to the orders and decrees of the court",
        "paragraph_id": "para_564"
      },
      {
        "text": "or the official having jurisdiction thereof.” 18 U.S.C. § 981(c). The",
        "paragraph_id": "para_565"
      },
      {
        "text": "government notes that section 981(c) ordinarily bars plaintiffs from",
        "paragraph_id": "para_566"
      },
      {
        "text": "initiating process against property already subject to a civil-forfeiture",
        "paragraph_id": "para_567"
      },
      {
        "text": "proceeding. But the government does not argue that section 981(c)",
        "paragraph_id": "para_568"
      },
      {
        "text": "bars attachments specifically authorized by TRIA. For good reason,",
        "paragraph_id": "para_569"
      },
      {
        "text": "because TRIA’s attachment provision applies “[n]otwithstanding",
        "paragraph_id": "para_570"
      },
      {
        "text": "any other provision of law.” TRIA § 201(a). We have said that this",
        "paragraph_id": "para_571"
      },
      {
        "text": "phrase “clearly requires courts to disregard other statutory provisions",
        "paragraph_id": "para_572"
      },
      {
        "text": "that conflict with the scope of the TRIA.” Greenbaum v. Islamic",
        "paragraph_id": "para_573"
      },
      {

      {
        "text": "Only one argument remains—that our holding might",
        "paragraph_id": "para_576"
      },
      {
        "text": "disrupt the Victims Fund. As explained above, the Fund is now",
        "paragraph_id": "para_577"
      },
      {
        "text": "financed largely through forfeiture actions pursued by the",
        "paragraph_id": "para_578"
      },
      {
        "text": "United States against the blocked assets of terrorist parties. So,",
        "paragraph_id": "para_579"
      },
      {
        "text": "when a judgment holder invokes TRIA to recover assets that",
        "paragraph_id": "para_580"
      },
      {
        "text": "would otherwise be forfeited, he takes funds that would",
        "paragraph_id": "para_581"
      },
      {
        "text": "otherwise be distributed more broadly and more equitably to",
        "paragraph_id": "para_582"
      },
      {
        "text": "similarly situated holders of terrorism-related judgments.",
        "paragraph_id": "para_583"
      },
      {
        "text": "We appreciate the force of this argument as a policy",
        "paragraph_id": "para_584"
      },
      {
        "text": "matter. Nevertheless, Congress did not expressly modify TRIA",
        "paragraph_id": "para_585"
      },
      {
        "text": "when it created the Victims Fund, and we may not assume that",
        "paragraph_id": "para_586"
      },
      {
        "text": "it did so impliedly. See Am. Forest Res. Council v. United",
        "paragraph_id": "para_587"
      },
      {
        "text": "States, 77 F.4th 787, 799 (D.C. Cir. 2023) (noting the “strong",
        "paragraph_id": "para_588"
      },
      {
        "text": "presumption that repeals by implication are disfavored and that",
        "paragraph_id": "para_589"
      },
      {
        "text": "Congress will specifically address preexisting law when it",
        "paragraph_id": "para_590"
      },
      {
        "text": "wishes to suspend its normal operations in a later statute”",
        "paragraph_id": "para_591"
      },
      {
        "text": "(cleaned up)). Moreover, in creating the Victims Fund,",
        "paragraph_id": "para_592"
      },
      {
        "text": "Congress expressly provided that plaintiffs whose judgments",
        "paragraph_id": "para_593"
      },
      {
        "text": "are not fully satisfied by distributions from the Fund retain the",
        "paragraph_id": "para_594"
      },
      {
        "text": "right to satisfy their judgments through other mechanisms—",
        "paragraph_id": "para_595"
      },
      {
        "text": "which presumably would include TRIA collection actions. See",
        "paragraph_id": "para_596"
      },
      {
        "text": "34 U.S.C. § 20144(d)(5)(B). In sum, any anomaly in the",
        "paragraph_id": "para_597"
      },
      {
        "text": "interaction between the Victims Fund and TRIA is a problem",
        "paragraph_id": "para_598"
      },
      {
        "text": "for Congress, not the judiciary.",
        "paragraph_id": "para_599"
      },
      {
        "text": "Republic of Iran, 67 F.4th 428, 432 (D.C. Cir. 2023). So, if TRIA",
        "paragraph_id": "para_600"
      },
      {
        "text": "specifically allows attachments that the civil-forfeiture statute",
        "paragraph_id": "para_601"
      },
      {
        "text": "specifically prohibits, TRIA prevails.",
        "paragraph_id": "para_602"
      },

        "text": "Neither sovereign immunity nor the prior exclusive",

        "text": "jurisdiction doctrine barred the attachment proceedings",
        "paragraph_id": "para_606"
      },

        "text": "pursued by the Owens and Levin plaintiffs. We reverse the",
        "paragraph_id": "para_607"
      },

        "text": "order quashing these plaintiffs’ writs of attachment.",
