        "text": "Upon considering the motions for a preliminary injunction of the Protecting",
        "paragraph_id": "para_18"
      },
      {
        "text": "Americans from Foreign Adversary Controlled Applications Act, Pub. L. No. 118-50, div.",
        "paragraph_id": "para_19"
      },
      {
        "text": "H, the response from the Government, and the replies from the petitioners, it is",
        "paragraph_id": "para_20"
      },
      {
        "text": "ORDERED that the motions be denied. At the request of the parties, this court",
        "paragraph_id": "para_21"
      },
      {
        "text": "expedited its consideration of the case “to ensure that there is adequate time before the",
        "paragraph_id": "para_22"
      },
      {
        "text": "Act’s prohibitions take effect to request emergency relief from the Supreme Court.” Joint",
        "paragraph_id": "para_23"
      },
      {
        "text": "Mot. to Set Briefing and Oral Argument Schedule 8 (May 17, 2024). Consistent with the",
        "paragraph_id": "para_24"
      },
      {
        "text": "schedule proposed by the parties, on December 6, 2024 this court unanimously upheld",
        "paragraph_id": "para_25"
      },
      {
        "text": "the constitutionality of the Act with respect to each claim presented by the petitioners",
        "paragraph_id": "para_26"
      },
      {
        "text": "and denied as moot the petitioners’ alternative requests for a temporary injunction and",
        "paragraph_id": "para_27"
      },
      {
        "text": "to appoint a special master.",
        "paragraph_id": "para_28"
      },
      {
        "text": "The petitioners now seek a “temporary pause” in order “to create time for further",
        "paragraph_id": "para_29"
      },
      {
        "text": "deliberation.” They argue the injunction will “permit the Supreme Court to consider this",
        "paragraph_id": "para_30"
      },
      {
        "text": "case in a more orderly fashion” and “give the incoming Administration time to determine",
        "paragraph_id": "para_31"
      },
      {
        "text": "its position on this exceptionally important matter.” The petitioners are not, however,",
        "paragraph_id": "para_32"
      },
      {
        "text": "“merely seeking a stay of [this] court’s order, but an injunction against the enforcement",
        "paragraph_id": "para_33"
      },
      {
        "text": "of a presumptively valid Act of Congress.” Turner Broad. Sys., Inc. v. FCC, 507 U.S.",
        "paragraph_id": "para_34"
      },
      {
        "text": "1301, 1302 (1993) (Rehnquist, C.J., in chambers). Such a “temporary injunction against",
        "paragraph_id": "para_35"
      },

        "text": "enforcement is in reality a suspension of an act, delaying the date selected by Congress",
        "paragraph_id": "para_40"
      },
      {
        "text": "to put its chosen policies into effect.” Heart of Atlanta Motel, Inc. v. United States, 85",
        "paragraph_id": "para_41"
      },
      {
        "text": "S. Ct. 1, 2 (1964) (Black, J., in chambers). That is particularly true here because the Act",
        "paragraph_id": "para_42"
      },
      {
        "text": "reflects a deliberate choice on the part of the Congress and the President to set a firm",
        "paragraph_id": "para_43"
      },
      {
        "text": "270-day clock — subject to one (and only one) extension of up to 90 days granted by",
        "paragraph_id": "para_44"
      },
      {
        "text": "the President if certain conditions are satisfied — after which the prohibitions of the Act",
        "paragraph_id": "para_45"
      },
      {
        "text": "take effect with respect to TikTok. See Op. 18–19.",
        "paragraph_id": "para_46"
      },
      {
        "text": "The petitioners have not identified any case in which a court, after rejecting a",
        "paragraph_id": "para_47"
      },
      {
        "text": "constitutional challenge to an Act of Congress, has enjoined the Act from going into",
        "paragraph_id": "para_48"
      },
      {
        "text": "effect while review is sought in the Supreme Court. The petitioners rely upon their",
        "paragraph_id": "para_49"
      },
      {
        "text": "claims under the First Amendment to justify preliminarily enjoining the Act. As to those",
        "paragraph_id": "para_50"
      },
      {
        "text": "claims, this court has already unanimously concluded the Act satisfies the requirements",
        "paragraph_id": "para_51"
      },
      {
        "text": "of the First Amendment under heightened scrutiny. In light of that decision, the time",
        "paragraph_id": "para_52"
      },
      {
        "text": "available to the petitioners to seek further review in the Supreme Court, and the interest",
        "paragraph_id": "para_53"
      },
      {
        "text": "in preserving the Supreme Court’s discretion to determine whether and to what extent to",
        "paragraph_id": "para_54"
      },
      {
        "text": "grant any interim injunctive relief while that Court considers a petition for a writ of",
        "paragraph_id": "para_55"
      },
      {
        "text": "certiorari, a temporary injunction of the Act from this court is unwarranted.",
