Is an electronic signature legally valid in the EU?
- What applies?
- An electronic signature may not be denied legal effect solely because it is electronic; a qualified electronic signature has the same effect as a handwritten signature and is recognised in all Member States.
- What must I do?
- Choose the signature level the document requires. Use a qualified electronic signature where handwriting is required by law. Keep the signed file and the validation data. Check the provider on the EU trusted list.
- What happens if I do nothing?
- There is no penalty for the signer; the risk is evidential, as a simple signature can be harder to prove in court.
- Who regulates this?
- National supervisory bodies for trust services
- What is the deadline?
- not_in_register
