Is an electronic signature legally valid in the United States?
- What applies?
- A signature or contract in interstate commerce may not be denied legal effect solely because it is electronic; consumer disclosures required in writing need the consumer's affirmative electronic consent.
- What must I do?
- Get the consumer's affirmative consent before sending required disclosures electronically. Tell the consumer how to withdraw consent and get paper copies. Keep an accurate, reproducible record of the signed document. Use paper for excluded documents such as wills and certain court and utility notices.
- What happens if I do nothing?
- Disclosures delivered electronically without valid consent do not satisfy the writing requirement, so they must be provided again on paper.
- Who regulates this?
- No single regulator; courts and the federal agencies for each regulated sector
- What is the deadline?
- Consent must be obtained before records are provided electronically.
